Terms of Service

1. Agreement to Terms

By accessing or using the website at taxappealhelp.com (the "Service"), operated by Jacobi Store, LLC d/b/a TaxEquity ("TaxEquity," "we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. By using the Service, you also agree to our Privacy Policy.

2. Description of Service

TaxEquity provides property tax appeal assistance for residential properties in Johnson County and Wyandotte County, Kansas. We offer two service tiers:

  • Self-Service ($89.00 one-time fee): We provide appeal documents, comparable sales research, and step-by-step instructions for you to file your own appeal.
  • Agent-Assisted (30% contingency fee): A licensed real estate professional handles your appeal from start to finish, including attending hearings on your behalf. You are only charged if your appeal results in a reduction of your assessed property value. The fee is 30% of your first-year tax savings.

3. User Accounts

You must create an account to use the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

4. Payment Terms

Self-Service Tier: The $89.00 fee is charged at the time of case creation and is non-refundable once appeal documents have been generated.

Agent-Assisted Tier: No upfront payment is required. A valid payment method must be on file. If your appeal results in a reduction of your assessed property value, we will charge 30% of your first-year tax savings to the payment method on file. By providing a payment method, you authorize this charge.

All payments are processed securely through Stripe. TaxEquity does not store your full credit card number.

5. No Guarantee of Results

Property tax appeals are subject to the decisions of the applicable county and the Kansas Board of Tax Appeals. We do not guarantee that any appeal will be successful or that your property assessment will be reduced. Past results are not indicative of future outcomes.

The information and documents we provide are based on publicly available assessment data and comparable sales. While we strive for accuracy, we do not warrant that this information is error-free.

6. Electronic Signatures and Authorization

For agent-assisted cases, you will be asked to electronically sign a Declaration of Representative (Kansas PV-AP-9 form) authorizing TaxEquity and its designated agents to act on your behalf. By signing electronically, you agree that your electronic signature carries the same legal effect as a handwritten signature.

7. User Responsibilities

You agree to:

  • Provide accurate property and personal information
  • Respond to communications from TaxEquity and assigned agents in a timely manner, particularly given appeal deadlines
  • Not use the Service for any unlawful purpose
  • Not attempt to access other users' accounts or data
  • Not interfere with the operation of the Service

8. Intellectual Property

All content, design, and functionality of the Service are owned by TaxEquity and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our written permission.

9. Limitation of Liability

To the fullest extent permitted by law, TaxEquity shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of tax savings, missed appeal deadlines, or errors in property data sourced from county systems.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to TaxEquity in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless TaxEquity, its officers, employees, agents, and contractors from any claims, damages, or expenses arising from your use of the Service or your violation of these Terms.

11. Third-Party Services

The Service integrates with third-party services including Stripe (payments) and county government websites (property data). We are not responsible for the availability, accuracy, or practices of these third-party services.

12. Modifications to Terms

We may update these Terms from time to time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Termination

You may close your account at any time by contacting us at support@taxappealhelp.com. We may terminate or suspend your access for violation of these Terms. Upon termination, any pending obligations (including contingency fees for successful appeals) remain in effect.

14. Governing Law

These Terms are governed by the laws of the State of Kansas. Any disputes shall be resolved in the courts of Johnson County, Kansas, or the county applicable to the dispute.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Jacobi Store, LLC d/b/a TaxEquity regarding the Service.
